Terms and Conditions
Buying at Filter & Co is a reassurance in itself. With a clear navigation to the general terms and conditions, you don't have to fear for small snacks under the grass.
General Sales, Delivery and Payment Terms (version 05/2017) 1. General products
1.1. Application: Only current general terms and conditions apply to our commercial relationships. The buyer is expected to assume it, purely due to the fact of his order. Any deviations, even if stated on the buyer's order form, only apply if in writing. Even in that case, current conditions remain applicable for all points that have not been expressly deviated from.
1.2. Jurisdiction of the courts: entered into all contracts by the Filter & Co BVBA, only Belgian law applies. For all disputes, only the courts of Kortrijk are authorized.
2. Prices, sacrifices and orders
2.1. Prices: Our prices are net and excluding VAT. All taxes, rights and costs, and in particular the costs listed below, are charged to the buyer.
2.2. Offers: prices are only binding due to a written confirmation of us. The period of validity of the sacrifices is limited to 30 days, unless stated otherwise. Our pricing quotes are based on the current copper rates and rates at that time. We reserve the right to adapt the prices to the applicable copper rates & rates on the date of the order.
2.3. Orders: the buyer is irrevocably committed by his order, but we are only responsible for after written confirmation from us. Filter & Co reserves the right at any time to delete the order, apart or only partially execute without any compensation or redress rights for the customer. At the request of the customer, Filter & Co retains the right to delete the order if a compensation determined by filter & co.
3. Deliveries
3.1. Risk: The goods are always sent at the risk of the buyer, even if they are delivered by us.
3.2. Delivery time: The delivery times are only given for information and do not bind the seller. Delays do not give the right to compensation or to the order from the order.
3.3. Deliveries for an amount
- > €50 free shipping in Belgium,
- > €100 free shipping in France and Luxembourg.
Unless otherwise specified, all other deliveries are subject to a flat-rate contribution of at least
- 6€ in Belgium,
- €15 in France and Luxembourg.
3.4. ROADTAX contribution: A contribution from EUR 1.25 is charged for each delivery.
3.5. Invoicing: Unless otherwise specified, the invoicing will be made on the date of the provision of the material. The storage of the goods is at risk of the buyer from the date of the provision of the material. If the buyer does not collect or receive the goods within a period of 10 working days after their posting, Filter & Co may delete the order without any compensation.
4. Return
Sold goods are reversed, nor exchanged. Preserved prior written agreement, this can be deviated from. Filter & Co charges € 50 per file for this. The return must be done francs.
5. Environmental contribution
An environmental contribution will be charged on the goods involved and according to the rates that are at that moment at Recupel, PV Cycle Belgium and any other approved organism. No discounts can be granted on those by filter & co filtered environmental contributions.
6. Complaints and warranty
6.1. Complaints: All complaints related to delivery or with the invoice must be reported in writing within eight days after the date of receipt of the goods, respectively from the invoice. The goods that are the subject of a complaint must continue to control for our decision; They will be believed to be accepted by the customer when they no longer have to recognize or already processed.
6.2. Warranty: The product guarantee is limited to the manufacturer's warranty and its period starts at the time the product is made available. Our responsibility is limited to the guarantee of the product. Our responsibility remains limited in any case to the value of the goods. In no case, we will be held responsible for indirect or additional damage.
6.3. Our advice and studies remain for information, without any commitment or responsibility of us.
7. Special packaging, tolerance
All special packaging (such as palettes, containers, etc.) remain our property and are made available to the customer for a period of 6 months, which starts on the day of delivery. If this period has elapsed without the packaging being returned, it will be invoiced to the customer. If special packaging will be returned within 12 months after invoicing to Filter & Co, a credit note can be drawn up. Special packaging will be returned to our Franco. The invoiced quantities are the ones that were delivered effectively.
8. Payments
8.1. Payment term: all invoices are payable in cash, unless otherwise agreed. The exceeding of a banking day can entail the claimability of all (perceived or not) invoices from the customer. In the event of non-payment, we reserve the right to stop further deliveries, performance & services and to regard the agreement by operation of law and without prior notice of default for the whole of whether the part that has not yet been carried out.
8.2. Intrest: In the event of non-payment of the invoice within the stipulated period, conventional interests are owed by operation of 11% by law and without prior notice of default, to be calculated from the due date of the invoice to the date of receipt of the payment.
8.3. Compensation: In the event of non-payment on the due date, the invoice amount increased by law and without notice of default by 15%, with a minimum of 75 EUR and a maximum of EUR 5,000, to the title of conventional damage clauses as standard compensation for extrajudicial costs and this without prejudice to the legal expenses and on top of the projection interest.
8.4. Payments allocation: According to art. 1254 of the Dutch Civil Code.
9. Retention of title
The goods remain the property of the seller to receive full payment.
10. Compensation

2. Prices, offers and orders

2.3. Orders: The Buyer undertakes irrevocably by ordering. Our written confirmation is worth commitment from us. Filter & Co reserves the right at any time to carry out partially, to suspend or cancel the order without any compensation or recourse of the customer. At the request of the Customer, Filter & Co reserves the right to cancel the order for an indemnity determined by Filter & Co.
3. Delivery
3.1. Risk: Goods are still traveling to the risks and perils of the buyer, even in the event that delivery is Franco by us.
3.2. Delivery time: Delivery times are only indicated by informational purposes and do not engage the seller. No compensation or order cancellation can be claimed in case of delivery delay.
3.3. Shipping: Deliveries above EUR 300 are Franco. Unless otherwise provided, any other delivery will be invoicing a cost of transportation of EUR 15 minimum.
3.4. Contribution Roadtax: Any delivery will be subject to billing of EUR 1.25.
3.5. Invoicing: unless particularly provision, the billing will be established at the date of the provision of the material. The conservation of the goods is at the risks of the buyer as of its provision. FILTER & CO may cancel the order without any compensation in the event of non-removal or non-receipt by the buyer within 10 working days from the date of its provision.
4. Back
The goods sold are neither occasions nor exchanged. Exceptions may be made with our written and prior agreement. In this case it will be made a deduction for administrative costs of a minimum amount of 50EUR. The return must be Franco.
5. Environmental contribution

6. Claims and guarantee
6.1. Claims: All claims about the delivery or invoice must, under penalty of nullity, we are submitted in writing within eight days of the date of receipt of the goods or receipt of the invoice respectively. 7. Special packing, tolerance
All special packaging (pallets, containers, ...) remain our property and are made free of charge to the customer for a period of 6 months from the date of delivery. After this period and failing to return, they will be charged to the buyer. A credit note may be established in the event of a refund within a maximum of 12 months following the date of invoicing of the special packaging. Any restitution remains the responsibility of the customer. The quantities invoiced are those actually delivered.
8. Payments
8.1. Payment Deadlines: Unless otherwise specified, all invoices are payable in cash. Failure to comply with a due date may result in the requirements of all receivables - even not due - of the customer. In case of non-payment, we reserve the right to terminate the deliveries, benefits and services and to consider, with respect, and without any formal notice, the contract as terminated for its entirety or for the party which has not yet executed.
8.2. Interests: In case of non-payment of the invoice within the time limit, it will be charged without any formal notice of a conventional interest equal to 11%, from the date of due date of the invoice until the date of receipt. payment.
